The UK Settlement / Spouse Visa is for Indian nationals who wish to come to the UK, post marriage, to live with their spouse/partner. The spouse has to be a British citizen, holds Indefinite Leave to Remain or have a permanent right of residence.
In order to gain a UK spouse or marriage visa, you need to satisfy the following conditions and eligibility requirements:
- The parties in the marriage must be at least 18 years of age;
- Parties must be legally married to each other and plan to live together in the UK as a married couple;
- Meet the maintenance / income requirements.
- The applicant must satisfy the English Language requirements.
- The relationship must, without any doubt, be proved as genuine or subsisting with substantial evidence.
UK Settlement visa is initially granted for a period of 33 months. After this period, you would need to apply for an extension to your marriage settlement visa.
On completing 5 years in the UK, you would become eligible to apply for Indefinite Leave to Remain in the UK.
